Overview

These Terms of Use (“Terms”) govern your access and use of the Hypnotized Baby website and services (“Platform”). By accessing or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

Parent and Child Accounts – Supervision and Responsibility

  • Account Ownership

    • All accounts involving minors must be registered and owned by a parent or legal guardian. The parent’s account is the primary and legally responsible profile through which all payments, subscriptions, and transactions are processed.

  • Child Participation

    • Children may use the platform only for creative and educational purposes, under the active supervision of their parent or guardian. The child’s role is limited to creating and submitting digital banners or other creative works within the system.

  • Financial Transactions

    • All financial operations, including banner purchases, payouts, and any other monetary activity, are handled **exclusively through the parent’s PayPal account which must be provided as the email address upon registration**. Children do not have direct access to funds or any means to initiate or receive payments.

  • Safety and Privacy

    • The platform is designed to ensure a safe and educational experience for children. Contact information for minors is not collected, and all communications regarding payments or offers are managed via the parent’s registered email address.

  • Responsibility of the Parent

    • By maintaining an active subscription, the parent confirms that they understand and accept full responsibility for supervising the child’s use of the system and ensuring compliance with local laws regarding online activity by minors.

User-Generated Content

  • The Platform allows users to use, create, modify, and save custom templates and distribute visual materials.
  • You are solely responsible for the content you create and distribute using the Platform.
  • The owner of the Platform does not assume liability for:
    • legal compliance of user-generated content,
    • potential copyright, trademark, or other intellectual property infringements,
    • any damages, claims, or negative consequences arising from the use of such content.

Intellectual property

The Platform and its code are the property of the owner; users receive a limited license to use the service.

Premium Access & Payments

  • Access to seller's account is granted upon successful payment.
  • All payments are final and strictly non-refundable.
  • Access to seller's account is provided for 7 days from the time of purchase.
  • If the user can reasonably demonstrate that due to technical issues (server downtime, critical bugs) they were unable to access premium features, the owner will, after resolving the issue, extend the premium access by 7 additional days.
  • Beyond this, no refunds or financial compensations will be offered.

Use of the Platform

You agree not to use the Platform for illegal, harmful, or malicious purposes. You agree not to attempt to reverse engineer, modify, or exploit the Platform beyond the intended use. Any abuse, fraudulent activity, or violation of these Terms may result in immediate suspension or termination of your account.

Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or suitable for your specific needs.

Limitation of Liability

To the maximum extent permitted by law, the owner of the Platform shall not be liable for:

  • indirect, incidental, or consequential damages,
  • loss of data, profits, or opportunities,
  • issues resulting from third-party services (e.g., payment providers).

Account termination

Administrator may suspend or terminate accounts in case of abuse.

Changes to Terms

We reserve the right to modify these Terms at any time. Updated versions will be posted on this page, with the effective date adjusted accordingly. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

Governing Law
